The following terms of service (the "Terms") constitute a legally binding agreement between you (also referred to below as "User") and College Movers LLC ("College Movers"). These Terms govern your access to and use of (i) College Movers' websites, including without limitation its website at https://thecollegemovers.com (collectively, the "Websites"), and (ii) College Movers' telephone ordering platform (the "Telephone Platform") (collectively, the Websites and the Telephone Platform are referred to herein as the "College Movers Platforms"). These Terms also govern any services that you may receive through the College Movers Platforms, including, but not limited to, any services that you may receive from College Movers, its subsidiaries, or affiliates, or the Third Party Providers (defined below).
Please read these Terms carefully before accessing or using any of the College Movers Platforms, including before placing any order with College Movers for loading, unloading, or other help services, moving services, and/or any other services that may be offered through the College Movers Platforms (collectively, the "Services"). By accessing or using the College Movers Platforms, including by placing an order for Services online or via telephone, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the College Movers Platforms or receive any Services.
College Movers reserves the right to change these Terms at any time. If College Movers makes changes to the Terms, College Movers will notify you by revising the "Last Modified" date at the top of this document. College Movers encourages you to review these Terms periodically. If you continue to use any College Movers Platform after the revised Terms have been posted, you will be deemed to have accepted the changes.
College Movers is a technology and communications company that matches individuals seeking local moving services with independent third party service providers capable of providing loading, unloading, and other moving help services. College Movers is not a household goods mover or other transportation provider and does NOT provide moving services directly. College Movers is a property broker and referral and booking service that connects you with Third Party Providers of the Services.
Subject to your compliance with these Terms, College Movers grants you a limited, non-exclusive, non-sublicensable, non-transferable, and revocable license to access and use the College Movers Platforms solely for their intended purposes, including to place orders for Services and to view any content made available through the Platforms. Any rights not expressly granted herein are reserved by College Movers.
You may not: (i) remove any copyright, trademark, or other proprietary notices from any portion of the College Movers Platforms; (ii) reproduce, modify, or distribute any College Movers Platform except as expressly permitted; (iii) decompile or reverse engineer any portion of the Platforms; (iv) cause or launch any programs or scripts for the purpose of scraping, indexing, or otherwise data mining any portion of the College Movers Platforms; or (v) attempt to gain unauthorized access to or impair any aspect of the College Movers Platforms or its related systems or networks.
In order to place an order for Services, you must be at least 18 years of age and must provide College Movers with a valid e-mail address, phone number, and a valid credit or debit card. You authorize College Movers to charge the full amount for Services after you receive them.
When placing an order for Services, you may receive an estimate of fees and costs. College Movers attempts to provide a reasonably accurate estimate. However, unless otherwise expressly stated during booking that the estimated price is "fixed" or "binding," all estimates are non-binding and are not intended to be a guarantee of your final costs. Your total charges may be affected by the information you provide, the circumstances present on the day of Services, and the speed and duration of work performed. You acknowledge that your total charges may exceed the amount of any estimate given. All prices are subject to change based on availability and other factors.
You may change or cancel an order for Services at any time prior to the scheduled service date, subject to College Movers' cancellation policies. Modifications to an order may be subject to an increase or change in pricing depending on availability.
You may also discontinue Services at any time while Services are being performed, but you will be responsible for paying for the greater of the two-hour minimum or the amount of all Services performed through the time the order is discontinued. You agree that you will not directly solicit any Third Party Provider who has been matched by College Movers to perform Services on your behalf within a sixty (60) day period following a cancellation or cessation of Services.
College Movers is a card-only moving company. Payment is due upon completion of Services. College Movers accepts all major credit and debit cards. By providing your payment information, you authorize College Movers to charge your card for the full amount owed for Services rendered.
All liability protections are contingent upon full and timely payment for services rendered. If payment is not received in full, any pending or future damage claims will be considered null and void, and College Movers shall have no obligation to review, process, or respond to such claims.
College Movers and its Third Party Providers take great care with your belongings. However, in the event that an item is damaged during a move, you must report the damage to College Movers within 48 hours of the completion of Services. College Movers will work with you in good faith to resolve any documented damage claims. College Movers' maximum liability for any single item is limited to the depreciated value of the item at the time of the move, not to exceed the total cost of Services rendered.
College Movers is not liable for damage to items that were: (i) packed by the customer; (ii) pre-existing damage prior to the move; (iii) items of extraordinary value not disclosed prior to the move; or (iv) damage resulting from the customer's direction of the movers.
College Movers, its subsidiaries, affiliates, and their respective agents, employees, and contractors shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, including but not limited to lost profits, lost revenue, loss of business, personal injury, or other intangible losses arising out of or related to these Terms, the College Movers Platforms, your order for Services, and/or the Services performed, however caused, regardless of the theory of liability, and even if College Movers has been advised of the possibility of such damages.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so some of the above limitations may not apply to you.
Any dispute or claim arising out of or relating to this agreement or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
These Terms shall be governed by the laws of the State of Iowa, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Iowa for the resolution of any disputes not subject to arbitration.
